New Speed Camera Commissioner Role Explained

The Commissioners job is not to look into individual speed camera tickets, but to look for trends in the number and location of complaints.

 

The role is to provide the following:

  • quality assurance and reporting: to independently monitor and review current camera operations
  • investigate and review: any part of the system of the Commissioner’s choosing or as requested by the Minister
  • complaints management: any person who feels aggrieved by the camera system can lodge a complaint with the Commissioner.

Yes, they do accept email complaints, but they apparently don't have an email form worked out yet. 10th Feb 2012 ( Amazing when you consider that this should be part of the process.) In the mean time, I would send my complaint via their feedback form located here.

The Reference Group

The Commissioner has a group of helpers called the Reference Group which  is made up of experts across fields relating to road safety. Experts may be drawn from fields including road safety research, road safety engineering and road safety camera technology.

 

The functions of the Reference Group include:

  • advising the Commissioner about various aspects of the road safety camera system
  • providing advice and recommendations to the Commissioner in relation to any matter requested by the Commissioner.

The members of the Reference Group are appointed by the Minister for Police and Emergency Services, on the recommendation of the Commissioner.

The Commissioner is the Chairperson of the Reference Group, and will provide the terms of reference.

Members of the Reference Group may not act as expert witnesses or comment publicly on any matters currently under consideration by the Reference Group.

What can the Commissioner do about faulty speed cameras?

At least once a year the Commissioner must check the accuracy of speed cameras. At any time the Commissioner may also undertake investigations into the integrity, accuracy or efficiency of the road safety camera system.

The Commissioner may also investigate any complaints made about the camera system, while looking for whole-of-system issues.

The Commissioner must report on his findings annually to Parliament, and at any time may report to the Minister for Police and Emergency Services with recommendations to address any issues found.

The Commissioner must keep records of any investigations undertaken and complaints received.

What will the Commissioner do with complaints about the camera system?

The Commissioner has the power to accept complaints about any road safety camera system and conduct investigations for any systemic issues that may be present in the system. Complaints can be submitted from any person who is aggrieved by the system.

The Commissioner may also start an investigation of any road safety camera system at any time. The Commissioner can then make recommendations to the Minister for Police and Emergency Services based on his findings.

If the Commissioner is not investigating individual infringements, how will systemic problems be discovered?

The Commissioner will keep a record of all complaints received and will be familiar with each complaint, even though a complaint may be referred to another agency for further action.

If, for example, there is a pattern to the types of complaints that are made, or a particularly high number of complaints about one location or camera system, then the Commissioner could start an investigation into that issue, location or system, and make recommendations to the Minister for Police and Emergency Services.

How do I make a complaint about a speed camera?

If you are aggrieved by the road safety camera system you can make a complaint to the Commissioner. Complaints can be made by you or your representative at any time.
